Vacate Certain Right-of-Way
Why would someone want to vacate a certain right-of-way of such a small size (2.81′ x 17.8′)?
The above .png file is a portion of the original subdivision showing lot 9.
The next .png file is from the property appraiser’s office showing the vacated right-of-way, which does not appear on the tax map we were given. I found what I believe to be the northwest corner of the vacated right-of-way. We pulled a +/- distance west across the street to another found corner, and it was about 3′ short of the 55′ right-of-way shown on our tax map. Below is a description of the vacated right-of-way.
Eventually we’ll be setting right-of-way stakes for new sidewalks. We’re still searching for property corners, trying to make sense of it all. According to one of the residents, surveyors have set property corners feet off from where they should be. This is an old neighborhood. I found a deed from 1876. The west side of the street on the north end is not subdivided.
